Court Decision Likely to Have Far-reaching Implications in N.J.
In a decision having statewide impact, the Appelate Division of the Superior Court has reinforced the Supreme Court's 2007 Gallenthin decision holding that the New Jersey Constitution requires a finding of actual blight before private property may be taken for the purpose of redevelopment. In a case involving the City of Long Branch the Court remanded the matter to the trial court to require a showing of actual blight with regard to each property involved.The Asbury Park Press features Paul Josephson on the statewide impact of the decision.
